Texas Lawmaker Files Bill to Legalize Marijuana

A Texas lawmaker has introduced new legislation that would legalize recreational marijuana.

Filed by Representative Jessica González (D), House Bill 195 would allow those 21 and older to possess up to 2.5 ounces of marijuana, and up to 15 grams of marijuana concentrates. Adults could also gift cannabis to one another within those limits, as long as they’re not compensated for it.

The legislation would allow individuals to store up to 10 ounces at home, but any amount beyond 2.5 ounces would need to be secured in a locked container. However, the measure does not authorize home cultivation.

The Texas Department of Licensing and Regulation would oversee the commercial cannabis industry, including licensing for cultivation, processing, testing, transportation, and retail. The department would be required to begin issuing licenses by November 1, 2026.

Revenue from taxes and licensing fees would be distributed across several state functions: 10% for regulatory operations under DLR, 10% for the Department of Public Safety’s lab oversight, 20% for local governments with licensed cannabis businesses, and the remaining funds directed to the state’s Foundation School Program.

The legislation was filed as the legislature debates Senate Bill 5, just approved by the State Affairs Committee, which would place a statewide ban on hemp-derived THC.
