The law took effect in December 2023, while the first licensed non-medical marijuana sales began on August 6, 2024, when the Division of Cannabis Control issued the first dual-use dispensary certificates of operation. Adults may possess up to 2.5 ounces of marijuana and up to 15 grams of extract, while non-medical marijuana purchases are subject to a 10% excise tax in addition to state and local sales taxes.

The state’s newest program update lists 218 dual-use dispensaries with certificates of operation, along with 37 cultivators, 45 processors and six testing laboratories. The medical marijuana program includes 471,257 registered patients, with 465,892 unique patients having purchased medical marijuana as reported to OARRS by licensed dispensaries.
