Adult-use marijuana became legal in Ohio following voter approval in November 2023, with retail sales beginning August 7, 2024. Under the law, adults 21 and older can purchase and possess up to 2.5 ounces of marijuana and 15 grams of concentrates. Medical patients are allowed larger quantities as part of their 90-day supply limits.
Recreational marijuana is taxed at 10% in excise fees, in addition to the 5.75% state sales tax and local taxes that vary by jurisdiction. Medical purchases remain exempt from excise taxes but are still subject to applicable state and local sales taxes. Based on this tax rate, Ohio generated $80,691,263.155 in taxes from marijuana sales between August 7, 2024 and April 5.
