A newly released House spending bill spearheaded by Republicans includes language that would ban most cannabinoid-based products currently sold nationwide.

The legislation, introduced by the House Appropriations Subcommittee on Agriculture, Rural Development, Food and Drug Administration, and Related Agencies, includes a provision that would federally ban consumable cannabis products containing any measurable amount of THC—or any cannabinoid marketed to have similar effects. The bill is slated for a committee markup on Thursday.

The proposed language would dramatically alter the federal definition of hemp, which was first legalized under the 2018 Farm Bill during the Trump administration. If enacted, it would effectively criminalize a wide range of popular products, including those containing Delta-8 THC, THC-O, and even smokable hemp flower.

A press release from the subcommittee, chaired by Representative Andy Harris (R-MD), claims the bill is aligned with “the Trump Administration and mandate of the American people,” adding that it would “close the hemp loophole that has resulted in the proliferation of unregulated intoxicating hemp products”.
