The Drug Enforcement Administration (DEA) is renewing an effort to place five psychedelic compounds in Schedule I, more than four years after withdrawing an earlier proposal to impose the same restrictions.

The proposed rule published Wednesday covers DiPT, 4-OH-DiPT, 5-MeO-AMT, 5-MeO-MiPT and 5-MeO-DET. Public comments and requests for a hearing are due October 23.

If finalized, the change would subject possession, manufacturing, distribution and research involving the compounds to Schedule I controls and applicable criminal, civil and administrative penalties.

The renewed proceeding follows another round of scientific review.

DEA initially proposed scheduling the substances in January 2022 and announced a hearing that July. It subsequently withdrew both notices after determining that an updated evaluation from the Department of Health and Human Services (HHS) was appropriate.

DEA requested that evaluation in November 2023. HHS delivered its updated recommendation supporting Schedule I placement on April 2, 2026.

The withdrawal therefore delayed the scheduling effort without ending it. Wednesday’s notice restarts the public process, giving interested parties another opportunity to challenge the proposed restrictions before DEA makes a final determination.
