Smart & Safe Florida has now submitted 386,637 valid signatures to the Florida Division of Elections in support of a proposed constitutional amendment to legalize recreational marijuana, with the group hoping to put the proposal to a vote in 2026.
The total, confirmed as of June 16, brings the campaign to nearly 44% of the 880,062 signatures required by the February 2026 deadline.
The initiative would legalize the possession, use, and purchase of marijuana for everyone 21 and older, bringing Florida in line with the growing number of states that have legalized recreational use. Under the proposed amendment, individuals would be allowed to possess up to two ounces of marijuana for personal use. However, the measure explicitly prohibits smoking or vaping marijuana in public places, reinforcing existing clean air regulations and maintaining restrictions similar to those applied to tobacco.
If approved, the initiative would authorize existing Medical Marijuana Treatment Centers (MMTCs) to sell marijuana for recreational purposes, effectively jumpstarting the market through already-operating infrastructure. In addition, the measure would allow for the issuance of new adult-use marijuana licenses, creating opportunities for expanded industry participation beyond the current MMTCs. The amendment does not mandate home cultivation and leaves regulatory oversight details to be implemented by state agencies after passage.
Smart & Safe Florida has raised close to $20 million in campaign funds, with most of the contributions coming from the cannabis company Trulieve, which operates numerous dispensaries across the state.
The measure closely mirrors 2024’s Amendment 3, which received 56% support—just shy of the 60% required for passage. If approved in 2026, the new amendment would go into effect six months after Election Day, potentially making Florida the next state to legalize marijuana for recreational use.
