Maryland Lawmakers File Legislation to Allow On–Site Marijuana Consumption Establishments and Events

Maryland lawmakers have set the stage for a significant expansion of cannabis-related activities by prefiling Senate Bill 215 and House Bill 132 for the upcoming 2025 legislative session, which begins January 8.

The bills, introduced by the Senate Finance Committee and the House Economic Matters Committee, propose the establishment of on-site cannabis consumption establishments and regulated cannabis events.

The legislation outlines comprehensive guidelines for on-site consumption establishments, restricting initial license applications to social equity applicants. These establishments would be permitted to distribute, repackage, and process cannabis products, including cannabinoid beverages, for on-site consumption. However, smoking cannabis indoors remains prohibited. Local jurisdictions would retain authority to regulate hours of operation, impose zoning requirements, and even prohibit these establishments entirely.

Cannabis events, another focus of the proposed legislation, would allow consumption and retail sale of cannabis products within designated, restricted areas. Event organizers must obtain cannabis event registrations from the Maryland Cannabis Administration at least 60 days in advance. Vendor permits for these events, initially reserved for social equity licensees until mid-2028, would allow the sale of single-serving products in compliance with strict manufacturing, testing, and labeling standards. Events would also be subject to a $500 daily fee, with additional vendor fees based on attendance.

The bills emphasize public safety and regulatory oversight, including prohibitions on alcohol consumption, visible intoxication, and access by individuals under 21. Violations could lead to immediate cessation orders, fines, and misdemeanor charges.

If enacted, these measures will create new avenues for legal cannabis consumption and commerce while balancing local control and public health considerations.

HB 132 was filed by and assigned to the House Economic Matters Committee, whereas SB 215 was filed by and assigned to the Senate Finance Committee.
