New Jersey Marijuana Laws: Possession Limits, Home Growing and Legal Sales in 2026

Marijuana is legal in New Jersey for adults 21 and older, including possession, purchases from licensed dispensaries, delivery and use on qualifying private property. However, New Jersey remains one of the few recreational marijuana states that does not allow adults to grow marijuana at home.

Adults may legally possess up to 6 ounces of marijuana and marijuana products. Licensed dispensaries may sell up to the equivalent of 1 ounce in a single transaction.

New Jersey voters approved recreational marijuana legalization in November 2020, and licensed adult-use sales began in April 2022.

The state also maintains a separate medical marijuana program that allows registered patients to purchase up to 3 ounces during a 30-day period, receive priority service at medical dispensaries and make purchases without state sales tax.

Is Recreational Marijuana Legal in New Jersey?

Yes. Recreational marijuana is legal in New Jersey for adults 21 and older.

Adults may legally purchase marijuana and marijuana products from licensed dispensaries, possess marijuana within state limits and consume it on private property where the property owner allows its use.

A medical marijuana card is not required for recreational purchases.

New Jersey law refers to marijuana sold through the licensed recreational market as “cannabis,” while “marijuana” technically refers to cannabis obtained outside the regulated system. For simplicity, this guide generally uses marijuana when discussing both systems.

How Much Marijuana Can You Possess in New Jersey?

An adult 21 or older may legally possess up to 6 ounces of marijuana and marijuana products.

This is substantially higher than New Jersey’s retail purchase limit, which allows only 1 ounce equivalent in a single dispensary transaction.

Possession of more than 6 ounces of marijuana falls outside the state’s legalization protections and can result in criminal charges.

How Much Marijuana Can You Buy in New Jersey?

A licensed dispensary may sell an adult up to the equivalent of 1 ounce of usable marijuana in a single transaction.

That can consist of:

  • 28.35 grams, or 1 ounce, of dried marijuana flower
  • 4 grams of solid marijuana concentrate or resin
  • The equivalent of 4 grams of concentrate in liquid form
  • 4 grams of vaporized marijuana formulations
  • Up to 1,000 milligrams of THC in ingestible marijuana products

Customers may also purchase combinations of product types as long as the transaction remains within the state’s equivalency limit.

For example, a consumer could purchase one-half ounce of marijuana flower and 2 grams of concentrate in the same transaction.

Can Tourists Buy Marijuana in New Jersey?

Yes.

Adults 21 and older visiting New Jersey may purchase recreational marijuana from licensed dispensaries.

New Jersey does not require recreational customers to be state residents.

Visitors are subject to the same possession laws as residents, including the 6-ounce limit.

Marijuana purchased in New Jersey cannot legally be transported across state lines, even when traveling to another state where marijuana is legal.

Can You Grow Marijuana at Home in New Jersey?

No.

New Jersey does not allow recreational home marijuana cultivation.

The Cannabis Regulatory Commission states that current law does not give the agency authority to allow private or residential marijuana growing outside licensed commercial cultivation businesses.

There is therefore no legal recreational plant limit.

This makes New Jersey unusual among states with legal adult-use marijuana, most of which allow at least some form of personal cultivation.

A patient must receive authorization from a health care practitioner registered with the New Jersey Medicinal Cannabis Program.

How Much Medical Marijuana Can Patients Buy?

A registered medical marijuana patient may generally purchase up to 3 ounces, approximately 85 grams, during a 30-day period.

The patient’s health care practitioner determines the individual authorization, which may be lower than the maximum.

Terminally ill patients are exempt from the standard 3-ounce maximum.

This is a significant distinction from recreational purchases, which are limited to 1 ounce equivalent in a single transaction.

What Are the Benefits of a New Jersey Medical Marijuana Card?

New Jersey’s medical program continues to provide meaningful advantages despite recreational legalization.

Registered medical patients receive:

  • Up to a 3-ounce medical marijuana allotment during a 30-day period
  • No state sales tax on medical marijuana purchases
  • Priority service at dispensaries that serve both medical and recreational customers
  • Access to patient-only service periods where offered
  • Access for qualifying patients younger than 21
  • The ability to designate registered caregivers
  • Legal protections specific to medical marijuana patients

New Jersey eliminated the sales tax on medical marijuana effective July 1, 2022.

The state also offers free digital medical marijuana identification cards, while physical cards currently cost $10.

Does New Jersey Accept Out-of-State Medical Marijuana Cards?

New Jersey provides a temporary registration option for visiting medical marijuana patients.

A patient registered in another state’s medical marijuana program may apply for a nonrenewable six-month New Jersey medical marijuana card.

Where Can You Use Marijuana in New Jersey?

Adults generally may use marijuana on private property where the property owner allows it.

However, smoking or vaping marijuana is prohibited in most public locations where tobacco smoking is prohibited, including many:

  • Indoor public spaces

  • Restaurants
  • Bars
  • Public parks
  • Beaches

Municipalities may impose additional restrictions on marijuana use in public spaces.

Private property owners, landlords and employers may also restrict marijuana smoking or use on their property.

Are Marijuana Consumption Lounges Legal in New Jersey?

Yes.

New Jersey allows licensed dispensaries to operate cannabis consumption areas after receiving approval from both the Cannabis Regulatory Commission and the municipality.

The state’s first consumption lounges opened in 2025, and the program continued expanding in 2026.

By early 2026, licensed consumption areas were operating in Atlantic City, Merchantville and Newark, with additional endorsements approved by regulators during 2026.

Customers must be at least 21 to enter.

Consumption areas cannot sell alcohol, tobacco, food or beverages. Customers may bring or order food and nonalcoholic drinks.

Medical marijuana patients must be permitted to bring legally obtained medical marijuana into a consumption area, although a dispensary may prohibit recreational customers from bringing marijuana purchased elsewhere.

Is Marijuana Delivery Legal in New Jersey?

Yes.

Licensed recreational and medical marijuana dispensaries may provide delivery, and New Jersey also licenses standalone marijuana delivery businesses.

Municipalities may prohibit marijuana delivery businesses from being physically based within their borders.

However, municipalities cannot prohibit licensed businesses located elsewhere from transporting marijuana through the municipality or delivering marijuana to customers there.

Delivery availability varies by location and business.

Can You Use Marijuana in a Car in New Jersey?

No.

Driving while impaired by marijuana is illegal regardless of whether the marijuana was purchased recreationally or obtained through the medical program.

New Jersey prosecutes marijuana-impaired driving under the same general DUI law used for alcohol and other intoxicating substances.

New Jersey also has an open-container rule for marijuana.

An unsealed marijuana package generally must be stored in the trunk or, if the vehicle does not have a trunk, behind the last upright seat rather than in the passenger area.

Medical marijuana patients are not exempt from impaired-driving laws.

Can Local Governments Ban Marijuana Businesses?

Yes.

New Jersey municipalities have significant authority over marijuana businesses.

Local governments may prohibit one or more classes of marijuana businesses from operating within the municipality and may regulate businesses through zoning, licensing and other local requirements.

Municipalities may also impose a local marijuana transfer tax of up to 2%.

However, local governments cannot prohibit marijuana from being transported through the municipality or prevent lawful delivery to customers within their borders.

How Is Recreational Marijuana Taxed in New Jersey?

Recreational marijuana purchases are subject to New Jersey’s 6.625% state sales tax.

Municipalities may impose an additional local marijuana transfer tax of up to 2% on qualifying marijuana transactions.

New Jersey also imposes a Social Equity Excise Fee on marijuana cultivators when marijuana is sold or transferred to other licensed businesses.

For 2026, the Social Equity Excise Fee is $2.50 per ounce. The fee is imposed at the business level rather than as a separate consumer sales tax at checkout.

Medical marijuana purchases are exempt from New Jersey sales tax.

What Are the Penalties for Possessing Too Much Marijuana in New Jersey?

Adults 21 and older may legally possess up to 6 ounces of marijuana.

Possession of more than 6 ounces of marijuana or more than 17 grams of hashish is a fourth-degree crime under New Jersey law.

A fourth-degree crime can carry a sentence of up to 18 months imprisonment. New Jersey’s marijuana possession statute also allows a fine of up to $25,000 for possession exceeding the 6-ounce threshold.

Selling marijuana without a license, possessing marijuana with intent to distribute and cultivating marijuana illegally are governed by separate provisions and can carry more serious penalties.

What Are the Penalties for Growing Marijuana at Home?

New Jersey does not provide a personal home cultivation exemption for either recreational consumers or medical marijuana patients.

Growing marijuana can therefore expose a person to prosecution under the state’s controlled-substance manufacturing and cultivation laws.

The severity of potential charges depends on factors including the number of plants and whether prosecutors allege distribution or other commercial activity.

Because there is currently no legal personal plant allowance, adults should not assume that growing only one or two marijuana plants is protected by recreational legalization.

Are Recreational Marijuana Users Protected at Work?

New Jersey provides some employment protections related to lawful marijuana use.

The Cannabis Regulatory Commission states that marijuana use alone generally cannot be the sole determining factor in hiring or firing decisions.

Employers may still maintain drug- and alcohol-free workplaces and prohibit impairment while working. Employers may test employees in circumstances permitted by law, including when impairment is suspected or after certain workplace accidents.

Employment law can vary considerably based on occupation and circumstances, particularly for federally regulated or safety-sensitive jobs.

What Changed With New Jersey Marijuana Laws in 2026?

New Jersey’s basic adult possession limit, retail purchase limit and prohibition on home cultivation remained unchanged in 2026, but several other important marijuana-related changes took effect.

New Intoxicating Hemp Rules

New Jersey enacted a major overhaul of its laws governing intoxicating hemp-derived products.

Legislation signed in January 2026 and amended in March established new definitions and restrictions for hemp-derived THC products.

Beginning April 13, products exceeding 0.3% total THC by dry weight or containing more than 0.4 milligrams of total THC per container generally fall outside the state’s definition of hemp and may instead be regulated as marijuana.

The law also prohibits selling products containing any detectable THC to people younger than 21 and prohibits chemically synthesized cannabinoids.

The state established temporary rules for intoxicating hemp beverages, including a 5-milligram THC-per-serving and 10-milligram-per-container limit beginning May 31.

Additional restrictions take effect November 14, 2026.

Consumption Areas Continued Expanding

New Jersey’s first marijuana consumption areas opened in 2025, and the Cannabis Regulatory Commission approved additional consumption-area endorsements in 2026.

These lounges provide legal locations for adults to consume marijuana outside private residences.

Retail Market Continued Expanding

New Jersey’s regulated market continued growing rapidly in 2026. The Cannabis Regulatory Commission’s dispensary directory now lists more than 320 licensed marijuana dispensaries across the state.
