Smart & Safe Florida has now submitted 612,576 valid signatures to the Florida Division of Elections in support of a proposed constitutional amendment to legalize recreational marijuana.
That figure represents 69% of the 880,062 signatures required by the February 2026 deadline.
Similar to 2024’s Amendment 3, the proposed initiative would legalize marijuana possession, use, and purchases for adults 21 and older. Individuals would be allowed to possess up to two ounces, though public smoking or vaping would remain prohibited.
If approved, the initiative would authorize licensed Medical Marijuana Treatment Centers (MMTCs) to begin selling marijuana for recreational use and allow for the issuance of additional adult-use licenses sometime after.
Smart & Safe Florida has raised nearly $20 million to support the effort, with most of the funding coming from Trulieve, a major cannabis operator in the state. The proposal is similar to Amendment 3, which earned 56% support—just short of the 60% threshold needed to pass.
If the new initiative qualifies for the 2026 ballot and wins voter approval, it would take effect six months after Election Day.
