Smart & Safe Florida has now submitted 661,331 signatures to the Florida Division of Elections in support of a proposed constitutional amendment to legalize recreational marijuana.

That number, as of August 1, represents 75% of the 880,062 valid signatures required to qualify for the 2026 ballot.
Although it makes several minor changes, the initiative mirrors the language of 2024’s Amendment 3, which would have legalized marijuana for adults 21 and older, allowing for possession and use of up to two ounces. In 2024, Amendment 3 garnered 56% support, falling just short of the 60% supermajority needed to pass.
Under the proposed law, licensed Medical Marijuana Treatment Centers would be allowed to sell marijuana for adult use, with additional adult-use licenses made available at a later date. Home cultivation and public consumption would remain prohibited.
Smart & Safe Florida has reported raising $21,219,586.60 for the campaign so far, with the vast majority of contributions coming from Trulieve, one of Florida’s largest cannabis operators.
If Smart & Safe Florida succeeds in placing their initiative on the November 2026 ballot, they may not be the only state voting on legalization, as proponents in Oklahoma are planning to launch a signature gathering campaign on August 6, with a goal of 300,000 signatures to put the proposal to a public vote next year.
