Illinois regulators say registered medical marijuana patients are not subject to a limit on the number of cannabis seeds they can purchase or possess, providing new clarification on the state’s home cultivation rules.
The Illinois Department of Financial and Professional Regulation (IDFPR) provided the clarification in response to questions from The Cole Memo, which asked whether seed purchases count toward a patient’s medical marijuana allotment and whether the state limits how many seeds a patient can acquire.
“Illinois law currently does not impose any limit on the number of cannabis seeds a registered medical patient may purchase or possess,” an IDFPR spokesperson said in the August 27 response.
The department also said the quantity of seeds a patient purchases or possesses has no bearing on the patient’s adequate medical supply under the state’s Compassionate Use of Medical Cannabis Program Act. The clarification is notable because Illinois law defines “usable cannabis” broadly enough to include seeds, along with leaves, buds and flowers.
Although seed possession itself is not capped, Illinois continues to place a firm limit on actual home cultivation. State law allows an Illinois resident who is at least 21 and registered as a qualifying medical marijuana patient to cultivate no more than five plants over five inches tall per household. Cultivation must occur in an enclosed, locked space, and the plants cannot be visible to the public.
The Cannabis Regulation and Tax Act specifically allows adult registered qualifying patients to purchase cannabis seeds from licensed dispensaries for home cultivation. Seeds purchased under that provision cannot be given or sold to another person.
The clarification follows Illinois’ transition to Metrc, the state’s newer seed-to-sale tracking system. State officials previously confirmed that the system is capable of tracking cannabis seeds through the regulated supply chain and into retail sales. Illinois began implementing Metrc in 2025, replacing the previous BioTrack system.
The practical result is that an eligible medical marijuana patient may legally purchase and possess more than five seeds, even though only five plants exceeding five inches in height may be cultivated at a household at one time.
