A legislative proposal that would make recreational marijuana legal for everyone 21 and older has been filed in West Virginia.
Delegate Sean Hornbuckle filed House Bill 4483 yesterday. The measure was assigned to the House Health and Human Resources Committee.
If passed into law, the proposal would make the possession of up to one ounce of marijuana legal for everyone who’s at least 21 years old. The law would allow marijuana tinctures, but would not allow marijuana concentrates such as hash, oil and wax.
The legislation would allow a system of licensed and regulated marijuana retail outlets, with the industry overseen by the Department of Commerce. The measure states that on or before June 1, 2024, the secretary of the department “shall promulgate legislative rules necessary for implementation of the provisions of this article.”
Application fees could not exceed $1,000 for marijuana growers with less than 100 acres, or $10,000 for those growing more than 100 acres.
“There shall be an excise tax to be levied upon cannabis sold or otherwise transferred by a cannabis cultivation facility to a cannabis product manufacturing facility or to a retail cannabis store at a rate of 17.5 percent of the sales price”, states the bill.
House Bill 4483 must be passed through the Health and Human Resources Committee as well as the Judiciary and Finance Committees before it can be considered by the full House of Representatives.
