Delaware’s recreational marijuana market is set to launch on August 1, officially making it the 22nd state in the U.S. with operational adult-use cannabis retail outlets.

The initial rollout will be limited to Delaware’s seven existing medical marijuana operators, who have received approval to expand into recreational sales. In total 13 dispensary locations across the state are expected to open their doors to adult-use customers on launch day.
Among the locations confirmed to begin sales August 1 are dispensaries operated by First State Compassion, Fresh Cannabis, Columbia Care Delaware, Field Supply, The Farm, and Best Buds. Retail outlets will be available in major cities including Wilmington, Newark, Dover, and Rehoboth Beach.
The state’s Office of the Marijuana Commissioner says this initial phase allows medical operators to serve as a foundation while the broader market is finalized. Eventually, Delaware’s recreational industry could include up to 125 licensees. However, that expansion has faced delays due to local zoning issues and a backlog in background checks.
While the limited rollout has sparked criticism from some advocates who argue it gives current medical businesses an unfair advantage, the August 1 opening still marks a major milestone for Delaware’s cannabis program.
Delaware legalized recreational marijuana in April 2023 when Governor John Carney allowed House Bill 1 and House Bill 2 to become law without his signature. Under the new law, adults 21 and older can legally possess up to one ounce of marijuana, including up to 12 grams of concentrates. Retail purchases will include dried flower, edibles, and other THC products. However, home cultivation remains prohibited for both medical and recreational users.
With retail sales beginning shortly, Delaware joins a growing list of states where marijuana is legally sold to adults, offering a regulated alternative to the illicit market and expanding consumer access across the Mid-Atlantic region.
