A sweeping lawsuit in Pennsylvania accuses more than a dozen companies of disguising high-potency marijuana and synthetic hemp products as legal, allowing them to skirt the state’s medical cannabis system and sell unregulated items through retail outlets and online.

The case was brought by Jushi Holdings’ subsidiaries against more than a dozen defendants, including Golden Hour Farms LLC, SUPERGREENSHEMPCO LLC, MC Botanicals LLC, MC Vivimus LLC, MC Nutraceuticals LLC, Revelry Supply Inc, DC Brands LLC, WYATT PURP LLC, Black Market Shoppe Limited Liability Co, and South Street Market.
According to the complaint, the companies marketed products as hemp but were actually distributing high-potency marijuana in unregulated forms. These products, sold without state-required safety checks, testing, or regulatory review, allegedly infiltrated Pennsylvania’s cannabis market through a network of retail outlets such as convenience stores, gas stations, vape retailers, and online sellers. Plaintiffs argue this undermines the state’s medical marijuana system by allowing unlicensed businesses to bypass licensing fees, child-safety measures, potency restrictions, and seed-to-sale tracking.
The lawsuit claims defendants used fraudulent Certificates of Analysis and sold products contaminated with pesticides, heavy metals, residual solvents, and other harmful substances. Some reportedly contained delta-9 THC levels far above the federal 0.3% limit while being mislabeled as compliant hemp.
Beyond the economic impact, the complaint states that unregulated products have created consumer confusion, leading to reputational damage for licensed dispensaries.
The plaintiffs are seeking to stop the defendants’ operations, safeguard Pennsylvania’s regulated cannabis system, and recover damages. If successful, the case could significantly reshape how intoxicating hemp products are handled in the state and potentially influence broader enforcement strategies nationwide.
