Ohio Marijuana Package-Size Rules Take Effect October 5, Setting Limits for Flower, Vapes, Edibles and More

A new Ohio rule establishing package-size and potency limits for marijuana products will take effect October 5, setting specific standards for flower, concentrates, vape products, edibles, beverages and several other product categories.

The rule, adopted by the Ohio Department of Commerce Division of Cannabis Control, applies to marijuana intended for direct sale to both recreational consumers and medical marijuana patients. It generally prohibits marijuana products from containing more than 90% THC.

Under the rule, packages of dried marijuana flower will be limited to one ounce. Raw single-serving units can contain no more than one gram of marijuana each, with a maximum of five grams per package.

Vape packages may contain up to three devices or cartridges, with each vaporizer limited to two grams and 90% THC. Similar restrictions apply to other marijuana concentrates, with packages allowed to contain up to three concentrate containers, devices or cartridges, each capped at two grams and 90% THC.

For recreational marijuana edibles, individual portions will remain capped at 10 milligrams of THC, with no more than 100 milligrams per package. Medical marijuana edibles may contain up to 55 milligrams per serving and up to 10 servings in a package.

Recreational marijuana beverages will be limited to 10 milligrams of THC per container, although as many as 12 beverage containers may be included in a single package. Medical beverages may contain up to 55 milligrams per serving, 110 milligrams per container and 220 milligrams per package.

The rule also establishes a 100-milligram package limit for oral pouches and strips, with individual servings capped at 10 milligrams. Capsules and pills may contain up to 50 milligrams of THC each and up to one gram of THC per package.

Topical sprays, salves, lotions and similar products will be limited to three ounces or 85 grams per package and no more than one gram of THC. Marijuana patches may contain up to 50 milligrams each and 500 milligrams per package.

Packages of clones, live plants or seeds will each be limited to six. Clones and live plants must remain in a vegetative state and cannot be sold once they have entered the flowering stage.

The Division of Cannabis Control said during the rulemaking process that the package standards are generally intended to maintain quantities and serving sizes already used in Ohio’s medical marijuana market while establishing corresponding requirements for recreational products. Daily purchase limits are governed separately.

The rule was filed in final form on August 25 and is scheduled to take effect October 5.
