Iowa Proposes Moving Medical Marijuana to Schedule III Under State Law, Sets October 20 Hearing

Iowa officials are proposing to move qualifying medical marijuana products to Schedule III under state controlled substances law, with a public hearing scheduled for October 20.

The proposal, detailed in a regulatory analysis published recently by the Iowa Department of Inspections, Appeals and Licensing, would place marijuana, marijuana extracts and naturally derived delta-9 THC into Schedule III when they are part of a product approved by the U.S. Food and Drug Administration or covered by a state medical marijuana license.

The changes would apply to products regulated under Iowa Code Chapter 124E, which governs the state’s medical cannabidiol program.

The proposed changes follow federal action taken April 28, when the Drug Enforcement Administration moved FDA-approved marijuana products and marijuana covered by state medical marijuana licenses from Schedule I to Schedule III. Marijuana outside those categories remains federally classified as Schedule I while broader rescheduling proceedings continue.

Under Iowa’s proposal, three categories of substances would be added to Schedule III: qualifying marijuana, marijuana extracts and naturally derived delta-9 THC. The regulatory language specifically excludes federally defined hemp from the new classification.

The Iowa Board of Pharmacy says the changes would benefit registered medical cannabidiol patients by recognizing the medical use of qualifying products and reducing the threat of federal enforcement against legitimate medical use.

The agency anticipates minimal additional implementation costs, noting that affected businesses already operate under state and federal controlled substance requirements. It also expects a small increase in state revenue from controlled substance registration fees paid by licensed medical marijuana manufacturers and dispensaries.

The proposed rescheduling is part of a broader regulatory package that would also add 20 substances to Schedule I, one substance to Schedule IV and three chemicals to Iowa’s list of regulated precursor substances.

Iowa’s existing medical marijuana program allows registered patients to purchase products in forms including vaporization products, capsules, tinctures and topicals. Smokable marijuana flower remains prohibited, and the proposed scheduling changes would not authorize recreational marijuana sales.

The public hearing is scheduled for October 20 at 10 a.m. at 6200 Park Avenue, Suite 100, in Des Moines. Virtual participation will also be available through the Department of Inspections, Appeals and Licensing.
