Federal Judge Grants Temporary Order Keeping New Jersey Marijuana Dispensary Open Amid Labor Peace Lawsuit

A federal judge has granted temporary relief allowing a Jersey City marijuana dispensary to remain open while it challenges licensing requirements tied to labor peace agreements.

U.S. District Judge Zahid N. Quraishi issued the order October 9 in the lawsuit brought by The Cannabis Place 420 Corp. According to the company’s announcement, the order halted the expiration of its municipal marijuana license for 14 days, preventing a closure that the business said would threaten approximately 20 jobs.

The dispute expanded after the Jersey City Council withdrew a resolution renewing the dispensary’s local support during its October 7 meeting. The company said its municipal license was scheduled to expire October 10.

The Cannabis Place added Jersey City as a defendant in an amended complaint filed October 9. Its original lawsuit, filed October 5, challenges New Jersey’s labor peace agreement requirements and names the New Jersey Cannabis Regulatory Commission, agency officials and United Food and Commercial Workers Local 360 as defendants.

The company alleges that the council withheld its renewal following comments from union organizing director Hugh Giordano about an ongoing labor dispute. It argues that using municipal licensing authority to influence that dispute interferes with matters governed by the federal National Labor Relations Act.

Giordano has disputed the company’s approach to negotiations, telling council members that the dispensary was obligated to bargain in good faith and criticizing its conduct during bargaining sessions.

The temporary order preserves the dispensary’s ability to operate while the litigation proceeds; it does not constitute a final ruling invalidating New Jersey’s labor peace requirements.

The Cannabis Place previously entered into a labor peace agreement with UFCW Local 360 in July 2024. According to its lawsuit, the company terminated that agreement in June 2026 after disagreements over bargaining and arbitration provisions.
